Farmers Party Request to be Enjoined in Presidential Petition Rejected

The Supreme court has today disallowed the farmers party application to be joined as Amicus Curiae for reasons that even though the application raised good issues of the perception of the ordinary voters on the election, the application also raises factual issues which have been raised by the petitioners and respondents.
Despite this Farmers party says it remains committed to ensuring the farmer interest is taken care of.
In a ruling seen by Times Digital the court said that the Applicant shall not add any useful purpose to the Court
“We note from the application that the applicant intends to address the Court on factual issues on whether the ordinary voter perceived the election process was free, verifiable and transparent; these issues are not limited to legal arguments, and further the issues are already addressed in the substantive petitions before us. We therefore exercise our discretion and disallow the application.
“The Notice of Motion dated 26th August 2022 by the Farmers Party of Kenya is disallowed. Parties shall bear their own respective costs.”
