The High Court has declined to issue orders stopping the planned burial of the late former Prime Minister Raila Odinga, clearing the way for the state and family to proceed with preparations for his final send-off in Bondo, Siaya County this weekend.
Justice Miriam Mwangi, sitting in Nairobi, dismissed a petition filed by a small group claiming that the burial arrangements violated constitutional and cultural provisions. The petitioners had argued that certain members of the extended Odinga family were not adequately consulted in setting the burial date and venue.
In her ruling, Justice Mwangi said the applicants failed to demonstrate how their rights were being infringed or how the burial posed any threat to public interest.“The court cannot interfere with family or state funeral arrangements that have been duly approved and coordinated within the law,” she stated. “The petition lacks merit and is hereby dismissed.”
The decision ends hours of speculation that the high-profile burial could face delays amid the ongoing national mourning period. Raila’s body is expected to be airlifted to Siaya on Saturday morning, where a state ceremony will be held before interment at his home in Opoda Farm.
Interior Cabinet Secretary Kithure Kindiki, who chairs the National Funeral Committee, welcomed the ruling, saying it brings clarity to the final phase of the funeral arrangements.
“We appreciate the court’s wisdom in allowing the process to continue without disruption. The government is committed to ensuring the late Rt. Hon. Raila Odinga is laid to rest with the honor and dignity he deserves,” Kindiki said during a press briefing.
Family spokesperson Ida Odinga also expressed relief, saying the family had been deeply affected by the legal distractions during the mourning period.“We thank all Kenyans for their patience and respect. Baba’s final journey to Bondo will be open to all who wish to bid him farewell peacefully,” she said.
Thousands of mourners, dignitaries, and international guests are expected to attend the burial, which will include a state ceremony, prayers, and cultural rites honoring Raila’s legacy as a freedom fighter and national leader.
Security has been tightened in Bondo and surrounding areas ahead of the burial, with several roads designated for VIP movement and public access routes clearly marked to prevent crowd-related incidents.
The funeral committee has urged the public to maintain order and follow guidance from security officers as the nation prepares to bid farewell to one of its most influential political figures.
