Kelvi Otieno Odhiambo was charged with robbery with violence contrary to section 296 (2) of the Penal Codewhere he is accused of robbing MWM of a mobile phone worth Sh30,000 and Sh250 on August 11 at Kanyama area.
The office of Director of Public Prosecutions (ODPP) says Odhiambo and his accomplice used violence against MWM during the incident.
Odhiambo’s accomplice escaped as members of the public rescued MWM and apprehended the accused person.
The suspect was also charged with rape contrary to section 3 (1) (a) of the Sexual Offences Act (SOA) of 2006.
Odhiambo is accused of raping MWM after robbing her and he faces an alternative charge of committing an indecent act with an adult. He denied the charges before Chief Magistrate Beatrice Kimemia of Makadara Law courts who granted him a bond of Sh300,000 without an option of a cash bail.
MWM was walking home at around 1am when she saw two men following her from behind.
She took off, but they caught up with her and one of them grabbed her by the neck as the other ransacked her handbag which had the phone and cash. One of them was armed with a knife during the incident.
The two stripped her naked after the alleged robbery and then raped her before members of the public gathered and went for her rescue.
Odhiambo’s accomplice escaped and ran away with everything they had allegedly robbed MWM. The suspect was handed over to the police who escorted him to the police station.
MWM was treated at Medisen San Frontiers (MSF) hospital where she was examined.
Three police officers who were on patrol on the night and who arrested Odhiambo are listed as witnesses in the case alongside a medic at MSF.
The case will be mentioned on August 27 before hearing starts on October 10.
