Judiciary Faulted for Prioritising The Executive
A lobby Group is now accusing the President of the Court of Appeal, Justice Daniel Musinga and the Chief Justice Martha Koome of favoritism.
The Nubian Human Rights Forum in a letter to the CJ and Appellate court president claim that their case that was filed in June 2020 is yet to receive a hearing date yet some recent cases of the same that were filed this year have been set for a hearing.
Shafi Ali Husein the Chair of Nubian Rights Forum says they appealed their case on Huduma number from last year but are yet to get a word from the judiciary.
“The Huduma case was filed in 2019 once the judgment was made in 2020 we appealed, until today we’ve not been heard. This is despite filing a certificate of agencys. Is the judiciary only prioritizing government applications? ” asked Shafi
The lobby is now threatening to hold demonstrations if their appeal is not heard and date for hearing of their case set.
“We want to be given equal access to justice. In our case we wanted marginalization and discrimination handled before transitioning to the Huduma Number, Attorney general came to appeal the case number 373 of Attorney General vs Katiba Institute which talks about Data Protection a case that comes after ours and it has been given a date.”
“We have been informed by our said advocates that since the Court issued directions for the patties to file submissions for both the Application and the Appeal, which directions the parties complied with, no further directions have been issued regarding the hearing and determination of the matter, thus undermining our right to justice. We understand that our counsel requests to the Hon Registrar and to your office for allocation of hearing dates have not received any positive response,” Added Shafi.
The said appeal was filed through our advocates Bashir, Noor & Co. Advocates on the 30 day of June 2020.
