DCI After Businessman Paul Kitonga for Issuing dud cheques in Mwache Dam tender scam

Police officers drawn from the DCI unit are looking for Businessman Paul Kitonga Daudi after he issued dud cheques.

The Businessman together with his Wife Stella Mary Mwangangi are the proprietors of Frontman Consultants.

Paul Kitonga Daudi has allegedly refused to honor a debt owed to businessman JNM who helped him execute the Mwache Dam consultancy services for implementation of the dam’s resettlement action plan (rap).

According to documents, the businessman was paid shs 17,142,328 as part of the shs 342 million contract sum.

The payment certificate by the Ministry of Water was prepared by Festus Karanja who is an Assistant Engineer, checked by Engineer Simon Kibachio the project coordinator and approved by Engineer Simon Mwangi the project manager.

The payment was effected on 14th June 2022.

Another certificate of shs 34, 284,657 was paid in April 2022 and earlier he had also been paid shs 34,284,657 in August 2021.

After refusal to pay the cash, Paul Kitonga was arrested in January 2021.

On 12th April 2021 he entered into a deed of settlement to pay the cash.

The deed was drafted by Daudi, Ng’ola and Kitheka Advocates.

According to the deed, Daudi was to pay a Mr JNM shs 9,500,00 advanced to him being
daily fee chargeable on the usage of one of JNMs Motor Vehicle.

“A total of five undated cheques in favor of JNM from PKD each of kshs 900,000 cumulatively totaling to kshs 4,500,000 which JKM shall date and deposit with his bank subject to availability of funds and the receipt by PKD of third installment payment of contract for provision of consultancy services for Mwache Dam rap and VMGP No. MOWI/KWSCRP-2/002/2018-2019,” reads the deed.

There was also additional five undated cheques in favor of JNM totaling shs 4,500,000 to be paid once the 4th installment of the contract is paid.

The case had been reported at Central Police Station under OB 47 dated 15th January 2021.

However, after the Payment Daudi allegedly rushed to withdraw and transfer all the money from his accounts to prevent JNM from banking the cheques.

However, Frontman Consultants are also wanted by KRA after the taxman written a demand letter to the Water Ministry to help recover shs 8.3 million from them.

The taxman said he is seeking to recover a total of shs 8,342,851.

The Mwache Dam tender was awarded in 2019.

The tender included resettlement of the vulnerable and marginalized group plan (vmgp) and was contract no. mows/kwscrp-2/002/2018-2019.

On 26th November 2021, KRA wrote to the Ministry to settle this cash instead of paying any monies owed to Frontman Consultants.

Frontman Consultants limited is registered by the registrar of companies as CPR/201277634.

The director’s particulars are Stella Mary Mwangangi ID number 24655662 and Paul Kitonga Daudi of ID number 20228470.

The KRAs demand letter was written by Northern Regional manager Geoffrey Sigei.
