Fantasy44.com Allegedly intruding privacy by sending unsolicited gambling ad messages to non-subscribed members
Online bookie Fantasy44.com has been accused of violating Kenyan rights and intruding into their privacy by sending unwanted gambling ad messages even to those who haven’t subscribed to their platform.
Kenyan consumers have been receiving the Fantasy44.com messages which they are using for direct marketing, which offer either incentives to gamble or alerts about upcoming games.

“I believe this is a scam and a way to keep me from unsubscribing. I have tried it numerous times but it won’t allow me to unsubscribe. This amount to the intrusion of privacy under the Data protection act, “an unhappy Kenyan said sharing a screenshot of the message.
Fantasy44.com is the newest gaming firm in Kenya and sending unsolicited messages for marketing is prohibited in any case.
Last year, former president Uhuru Kenyatta assented to the long-awaited data protection law that significantly changes how public and private entities handle users’ information.
The act stated that companies that send unsolicited text messages to consumers would face fines of up to 2 percent of their annual turnover if found guilty of violating the Data Protection Act 2019.
On direct marketing, the Data Protection Act states that personal data shall not be used for commercial purposes unless express consent has been sought and obtained from the recipient.
In 2019, The Betting Control and Licensing Board banned television advertising and gambling on all social media platforms.
In a notice signed by Acting Director Liti Wambua, the board also banned outdoor advertising of gambling, as well as advertising of gambling between 6 am and 10 pm.
This has prompted betting firms such as Fantasy44 who are new in the market to result sending messages to members who haven’t subscribed to their services.
Kenyans have now called on the government to ban betting companies’ violating’s Kenyans rights.
