Court declines to stop new security measures regulating public gatherings

The High Court on Thursday declined to temporarily stay the new security measures issued by the
National Security Advisory Council (NSAC) and approved by the Cabinet to regulate public gatherings.
Justice Antony Murima further directed that the respondents file and serve responses together with
written submissions by the close of business on Friday.
“In order to command orderly conduct of the court business, this court will abide by the orders of the
the court made on the 13th of this month. I will therefore not consider the request for interim conservatory
orders at this point in time,” Justice Murima ruled
The judge said the orders of the court were clear and that the matter was to be fixed before Justice
Weldon Korir for directions on the hearing further ordering the hearing of notice of motion to proceed
on October 21.
The Law Society of Kenya (LSK) led by its President Nelson Havi had moved to court challenging the new
security measures issued by NSAC and approved by the Cabinet to regulate public gatherings.
Among the orders, LSK was seeking include, restraining the police from seeking to license holding of
public gatherings, meetings, or banning, disrupting or interfering with peaceful public gatherings.
