How Kwale Land Registrar is Frustrating Land owners with Outrageous Demands

Legit land owners or buyers in Kwale County have to go through a tedious and well-orchestrated blackmail process aimed at making them submissive to any demands for their land titles to be processed.

In a scheme orchestrated by Kwale Land Registrar boss Stephen Mokaya, one has to part with a lucrative amount of money for their titles and green cards to be signed. In most cases, the office led by Mokaya has outrageously demanded a portion of the land under process.

This has been the case for years until recently when a number of land owners started involving investigative agencies to intervene in  pursuit of their land documents.

A case in point involves the Kwale/Diani S.S parcel of land where three family members have been taken through endless circles by the officer, whose aim as per our investigations is to render them vulnerable and submissive to his demands.

A letter dated 1st August 2024 to the County Land Registrar and copied to the Ethics and Anti-Corruption Commission and the Ministry of lands details the frustrations the family has been through in pursuit of the land title despite having met all legal demands.

From the letter, Mokaya is said to have issued a title deed for the  property  on 3rd July 2024 after demanding the legally  registered owner  to appear in person before him.

This is  despite a  court order that vested the three family members ownership of the property upon verification by Mokaya himself.

From this, he had all of a sudden forgotten the real owners and had embarked on mind games.
However, they still visited him in office  but were kept waiting till past 5pm for the title deed to be issued.

Despite Mokaya having seen them around in the morning, he ignored them until evening. The titles had already been signed just waiting for the owners to appear.

Thereafter, there were applications for search of property that were made but they have all been unsuccessful and the Applicants were informed that the certificates of official searches could not be issued because the green card has not been signed.

They visited the land registry to enquire about the same on 20th July 2024 and met him briefly outside the Land registry in which he confirmed the parcel file for the land.

Despite entering their entries on the green card and the serial number for the title deed, he intentionally refused to sign the green card and according to the aggrieved owners, Mokaya is illegally demanding to be allocated a portion of the land.

Our investigations reveal that a number of gullible land owners have fallen to his schemes that are aided by other land officers and land brokers in Kwale.

He has been able to acquire a lot of property through this scheme and a good example is Mvindeni Ukunda where he is building apartments.
