LSK Demands Justice for Families Affected by Extra Judicial Killings

The Law Society of Kenya (LSK) has noted with concern, the recent brutal extra judicial killings and involuntary deaths that have heightened over the past few months in our country and vehemently condemns the heinous acts.

Speaking today at the Milimani Law Court during the opening of the Legal Awareness Week, Faith Odhiambo, President, Law Society of Kenya, challenged the government over the recent gruesome and horrific killings which include Wells Fargo Group Human Resource Manager Mr. Willis Ayieko, found dead in Sabatia, Vihiga, four days later after going missing on the 18th October, 2024.

She added that “Other deaths include 23 year old Seth Nyakio Njeri, found dead in her house in the Biafra area in Thika, Kiambu County. 24 year old Christine Nyakio, found murdered in a swamp in Ngong after disappearing from her home. Waris Dahabo Daud, her daughter Nusayba Abdi Mohamed, and niece Amina Abdirashid whose mutilated bodies were discovered at Machakos, Park Road, and Bahati areas after they had gone missing from Eastleigh, Nairobi.”

LSK has also extended condolences to the family and friends of the deceased persons and promised to join them in the quest for justice and accountability from the respective Security Agencies.

The President reiterated that the recent happenings are an absolute and blatant violation of Human Rights and the Rule of Law and the lost lives have not been accounted for in any appropriate way by the Government of the day.

“Article 26 of the Constitution of Kenya, 2010 guarantees the right to life to every person and further emphasizes that the right to life to life shall only be deprived to the extent authorized by the Constitution or other written law,” she averred.

The institution has challenged Director of Public Prosecutions to immediately invoke his powers as donated by Article 157(4) of the Constitution of Kenya, 2010, and direct the Inspector General of Police to urgently conduct investigations and prosecute the perpetrators of these extra judicial killings and involuntary deaths and they be held to account.

Furthermore, LSK calls upon the Inspector General of Police and the Directorate of Criminal Investigations (DCI) to take the recent wave of horrifying murders seriously and perform their mandate as prescribed under Articles 245 and 247 of the Constitution of Kenya, 2010, respectively as the said offices are sworn to serve and protect the public and uphold the Rule of law.

The LSK further demands the Independent Policing Oversight Authority (IPOA) to embrace independence of the Institution, summon and sanction the Police Officers who adamantly refuse to cooperate with the investigating authorities to ensure suspects are brought to book as we, the LSK, SHALL NOT sit back and allow the Country to fall back to and witness
the unresolved incidences and mysteries of Rivers Tana and Yala floating bodies.

In addition, the LSK calls on the State, which is mandated to observe, respect, protect, promote, and fulfill the rights and fundamental freedoms in the Bill of Rights as enshrined in Article 21 (1) of the Constitution of Kenya, 2010 to ensure thorough and complete investigations, transparency and accountability on all the deaths.
