Uproar as State Counsel, Police Shield Senior Nairobi County Official On Assault Charges

Detectives at the Nairobi regional police command and some state counsel have connived to shield a senior official at City Hall from being charged for assaulting a step daughter with autistic disorder.
The Director of Prosecutions has recommended that the suspect be immediately charged for the offence.
Instead, family sources indicated that some senior officers at the Nairobi regional police headquarters and state counsel in the Office of the Director of Public Prosecutions had thrown a cordon around the county official not to be arrested and charged.
A 28 year old girl who suffers from Autism Spectrum Disorder (ASD), thus a person living with disability, was assaulted twice last December by her step mother, sustaining injuries in the neck.
The victim’s mother died some years back and the father married another wife, who has now turned out to be her tormentor.
The matter was reported to Gigiri Police Station where investigation was carried out and the file forwarded to the DPP for perusal and further direction.

On February 17, 2023 the Director of Public Prosecutions wrote to Gigiri Police Station directing the investigation officer to arraign the suspect.
“Kindly proceed and have the suspect arraigned before court for plea taking and further forward the file to our ODPP offices for plea-registration”, says the letter in part.
Our investigations have revealed that the girl’s step mother is a senior official in the Nairobi City County Government of the rank of deputy director, who is reportedly enjoying protection by State officers not to be arraigned before court over the alleged offence.
But the DPP’s recommendation says that: “having gone through the police file and the evidence presented by way of witness statements, medical examination report and the statement of the investigating officer, we find that the evidence as presented satisfies the threshold required to be admitted for approval”.
Family members now claim senior officers at the Nairobi regional police headquarters acting in cahoots with some State Counsel in the ODPP were frustrating the investigation officer from arraigning the suspect.
The suspect is also said to be having a strained relationship with her husband and she has reportedly moved out of their matrimonial home in Nairobi’s Runda Estate.
“She is bragging around that nothing will be done to her because she is on top of things”, a family source said.
Her husband who sought not to be named said he was living in fear because his estranged wife had made attempts to access his house at night accompanied by unknown people in unmarked vehicles.

He said the estranged wife made a false distress call to police headquarters on the night of January 9, 2023 claiming her husband had threatened to kill her but no evidence was established when detectives visited the home.
The husband, a businessman explained that he made a report to the police but the estranged wife had not been charged for giving false information to police.
