Dispute tribunal calls on ODM to nominate fresh candidate for Karen ward

The Orange Democratic Movement (ODM) appeals tribunal has resolved to cancel the Karen Ward nomination results.

The nomination results had favored incumbent David Mberia against 16 other aspirants who contested the results.

The tribunal chaired by Caroline Oduor found out that the nomination exercise was characterized by massive irregularities and malpractices such as failure by the polling agents to admit agents of all aspirants.

The tribunal also ruled that there was failure to announce results at polling centres and creation of ghost polling centres.

It was also found out that the incumbent did not meet the requirements for holding public office after having been convicted of a criminal offense.

The tribunal has warned that clearing the incumbent to contest may trigger a by-election if he wins and the outcome is contested.

The case has now been referred to the National Elections Board for appropriate action before submission of the final list to the IEBC.

At the same time,14 participants in the nominations under the leadership of ODM Secretary General for Langata Constituency Sulekha Abdi signed a Memorandum of Understanding where they endorsed Johnson Oduk as the Karen ward nominee.

Mr Oduk’s name was forwarded to the party’s election board for consideration before May 2nd when the IEBC receives names of cleared candidates.
