DPP Okays prosecution and arrest of former KPA boss Daniel Manduku

The Director of Public Prosecutions, DPP, Noordin Haji now wants the immediate former Kenya Ports Authority, KPA, Managing Director, MD, Daniel Manduku arrested over alleged irregular procurement of works at the Mombasa Port.

While approving the prosecution of Manduku, DPP Haji in a statement to newsrooms says that investigations conducted on the same have unearthed details that the authority made an excess of Kshs244 million to contractors for work not completed.

The DPP further says in the statement that there is sufficient and enough evidence to charge Manduku together with the authority’s works officer in charge, Juma Chigulu.

It is alleged that Manduku signed, authorized and approved the procurement of manufacturing of congrete barriers at the Inland Container Depot (ICD), the Kilindini Port and that of Makongeni Goods Shed with no approved budget and a procurement plan for 2018/19 financial year adding that there was no beforehand plans for the plan.

‘After independently reviewing the evidence gathered and upon perusal of the inquiry, my office has found that there was no requisition made by KPA’s user department for the concrete barriers,’ Haji says in the statement.

Manduku is also being accused of many other things, unlawful recommendation of the Nairobi Inland Cargo Terminal, NICT, despite the firm not tendering for the same, leading to seven bidders being removed from the tendering process, and also for allegedly colluding with others to defeat justice.

In a letter to Transport Cabinet Secretary ajames Macharia, Manduku resigned as KPA’s MD in March under unclear circumstances. It was effective 1st of June.

Macharia confirmed receipt of Mr Manduku’s resignation letter.

The former National Construction Authority (NCA) executive director, was first appointed to the position in an acting capacity on May 30, 2018, replacing Ms Catherine Mturi-Wairi who was sent on compulsory leave by the KPA board due to lack of effective leadership.

“I shall be eternally grateful for the support of all the outstanding individuals who have contributed to what we have achieved over the last few years and to you in particular for your leadership and vision,” read part of the letter to CS Macharia.
