Four petitioners challenge Mombasa county government cabinet nominees

Last week’s appointment of Mombasa County government executive members hangs in limbo after four petitioners moved to court.

Abdulmajid Busyayyid, Mesh Abdul, Maria Fernandes  and Mohammad Mohsin filed the matter at the Mombasa environmental and land court under certificate of urgency pointing out that the appointment is against the constitution on protection of rights and fundamental freedoms under rule 2013.

The petitioners are seeking the court to issue interim orders to stop the new appointees from taking over their respective offices until the matter is heard and determined.

They argued the order will restrain the new look cabinet which was appointed through an executive notice dated January 15 this year.       

Through their counsel Shabaan advocates they argued the appointment of the county executive committee members was not fair and transparent under the law.

They also argued the appointment lacked public participation and was carried out with a lot of secrecy and was against the constitution.   

Meanwhile, today was a great day for the Bajuni community after Mombasa governor Abdulswamad Shariff Nassir appointed Dr Mbwarali Kame

 to head the Education and Digital Transformation docket.

Hassan Albeity  Abdallah  lauded the appointment saying the community has highly educated people just like other communities in the country.

Omar, who was flanked by the community members, hailed Mombasa governor Abdulswamad Sherrif Nassir for appointing one of their own, Dr Mbwarali Kame, as executive committee member for Education and Digital Transformation.

He said the move by Abdulswamad’s administration to appoint Dr Mbwarali as member of his county executive is testimony to this.

“The journey for the community to be recognized at both the national and county level never begun yesterday but with the formation of the community council of elders,” he pointed out.   

Albeity refuted  claims the appointment of Dr Mbwarali was a favor saying he was part and parcel of the elders that ha entered into an arrangement with both the national and county governments.

He was addressing the media as he hailed Abdulswamad  for appointing  one of their own to the cabinet at Istiqama Academy in Mvita constituency Mombasa County.
