Just a day after the court allowed the Law Society of Kenya (LSK) to withdraw Sh19.6 Million from their accounts with two signatories instead of the reqired three, on Wednesday the High Court has suspended all resolutions and decisions that were made at the impugned LSK Special General Meeting last month.

In his ruling Justice Weldon Korir further ruled that the implementation of the resolutions shall cease forthwith and all activities arising from them are suspended.

The ruling with immediate effect reinstates Roseline Odede and Benard Ngetich as council members, who the Special Meeting had suspended.

Lawyer Adrian Kamotho had moved to court seeking to stop the implementation of the resolutions made at the SGM.

On Tuesday, Justice Alfred Mabea had allowed LSK to withdraw the monies from their accounts with two signatories instead of the required three after LSK President Nelson HaviA argued that two of the council members were no longer signatories.

The move will now disrupt operations at the LSK owing to the fact that Havi has not been in good terms with Oded and Ngetich having instigated their removal from the council.

The SGM that took place last month was called to discuss the appointment of auditors to probe LSK’s books of accounts, deliberate on an impeachment motion against Havi, the suspension of some council members and the appointment of advocates to represent the lobby in court cases involving internal wrangles.

Months of infighting have split the LSK into two factions, one backing Havi and another on CEO Mercy Wambua’s side.

Ms Wambua sued the LSK last year to stop her removal, and the High Court issued orders barring the discussion of the case or her removal at the SGM. That was not to be as the two factions traded accusations in the course of the meeting.

The SGM was also to settle the differences that have threatened to stall operations at the lawyers’ umbrella body but it turned chaotic leading to the above mentioned court cases.

During the chaotic SGM, Havi made it clear that ongoing efforts to unite the two factions will likely not work, an indication that the fights at the society are a long way from over.

“We have listened to your calls that we unite. But you must realise the queer nature of this… We come here with differences. There has been interference and I’ve taken to the podium here and said who is interfering with the running of LSK. So don’t come and tell me to unite with those people,” Havi said.
