Former KPA MD Daniel Manduku charged afresh

Anti-corruption magistrate Lawrence Mugambi directed that the two remain out on previous bond terms of 12 Million shillings after they pleaded not guilty to the fresh charges.

Former Kenya Ports Authority Managing Director Daniel Manduku and his co-accused Juma Fadhili have been charged afresh over abuse of office charges in a case where they are accused of misappropriating over KSh. 928 Million.

The prosecution, the two knowingly abused the authority of their office by misappropriating 678 Million shillings meant for repair and maintenance vote in the Kenya ports authority annual budget for the 2018-2019 financial year. 

The two are accused of committing the offense on 29th of March 2019 and 22nd August 2019 at Kenya ports authority headquarters in Mombasa County being the managing director and the accounting officer of the authority.

Juma Fadhili is also accused of abusing his office for knowingly and unlawfully preparing work evaluation certificates that were erroneous in his capacity as the works officer in the civil engineer department. 

The certificates are said to have been presented to the finance department at the Kenya ports authority by the respective contractors to claim payment occasioning overpayment of 244 Million shillings by the Kenya ports authority. The offense was allegedly committed between the 16th of May 2019 and 16th August 2019.

The two are also charged with engaging in a project without clear planning contrary to the law. According to the charge sheet, Manduku and Fadhili engaged in concrete barriers works project to manufacture at a cost of 1.4 Billion shillings without an approved budget or procurement plan.

The pretrial of the case will be heard in the first week of December.
