JSC to assess conduct of Judge who cleared Ann Kananu for vetting

The commission on Friday last week acknowledged receipt of a complaint raised against the judge by activist and politician Namiti Shitanda.

In the complaint letter, Shitanda castigated the judge for misconduct and blatant bias in handling cases filed to protest the vetting of Ann Kananu as the deputy governor for Nairobi City County.

“I wish to make a complaint against Judge Charo regarding the manner in which he is handling petition number 0006/2021, 007/2021 and 009/2021,”added Shitanda in his letter.

Activist Okiya Omtatah had moved to the court to seek conservatory orders to stop her vetting but the judge declined to issue consovertory orders.

Shitanda had also raised concerns of ambiguities which point to bias and interference granted that the same judge issued various court orders in favor of Ann Kananu.

“Incompetence is a ground for dismissal for dismissal of a judge coupled with buttresses that is now clear in the court cases surrounding the impeachment of Hon Mike Sonko.

The commission in its response said that it is fully in charge of the matter and that once the complaint is processed to completion, a communication will be made to the complainant.

“The Judicial Service Commission is now fully seized of the complaint which shall henceforth adopt JSC Petition No.11/2021 as its reference number. Kindly quote the same in all your future correspondence,” The commission wrote in a letter done by Director-Legal Services Isaac Wamaasa.

It is not clear how long the processing of the complaint will take but this could deal a new twist to the political battles at City Hall.
